MERC Terms & Conditions of Use


PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS SITE. Users of this website will be hereafter referred to variously as "you", "members", or "providers."

By using the MERC site (www.merconline.net) you signify your agreement to these Terms and Conditions. If you do not agree to these Terms and Conditions, do not use this site. MERC is a project of the National Center for Manufacturing Education (NCME), a National Resource Center funded by the National Science Foundation and based at Sinclair Community College, 444 West Third Street, Dayton, OH 45402. NCME may modify these Terms and Conditions at any time.

Restrictions of Use of Materials

The MERC website and its linked websites are copyright protected. Any textual or graphic material you copy, print, or download is licensed to you by NCME and/or its partners for your information and educational use only, provided that you do not change or delete any copyright, trademark or other proprietary notices.

If you download documents or other materials from the site, all files and images contained in or generated by these files and accompanying data are deemed to be licensed to you by NCME and/or its partners for your informational, educational, non-commercials use only. NCME does not transfer the intellectual property rights to the materials. You may not sell, redistribute or reproduce the materials unless permission to do so has been granted by NCME or its licensors. All trademarks and logos are owned by NCME or its licensors and you may not copy or use them in any manner.

Fees

NCME may charge a fee to cover the cost of full reproduction of certain documents abstracted or otherwise available on the MERC website, and to enable access to certain other materials or resources. In some cases, licensors and not NCME may charge fees for materials. NCME reserves the right to change its own fees at any time, but is not responsible for the individual fees set by its licensors. All materials and resources for a fee will be clearly posted on the website. Providers of materials should refer to the submissions section below for more information.

Disclaimers and Limitation of Liability

NCME may change, move, delete portions of or add to the MERC website from time to time.

The materials in this site are provided "as is" and "as available" and without express or implied warranties of any kind. NCME does not warrant or make any representations regarding the use or the results of the use of the content or other materials in this site in terms of their correctness, accuracy, reliability, or otherwise.

To the fullest extent permissible pursuant to applicable law, NCME disclaims all warranties, express or implied, including, but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement. Nothing in these terms shall be construed as limiting or reducing NCME's responsibilities and obligations to clients in accordance with applicable laws and regulations. NCME does not warrant that the functions contained in the materials available on this site will be uninterrupted or error-free, that defects will be corrected, or that the materials, this site or the server that makes them available are free of viruses or other harmful components. You (and not NCME) assume the entire cost of all necessary servicing, repair and correction.

Under no circumstances, including, but not limited to, negligence, shall NCME be liable for any special or consequential damages that result from the use of, or the inability to use, site or any downloadable materials, even if NCME or its representative has been advised of the possibility of such damages. In no event shall NCME's total liability to you from all damages, losses, and causes of action (whether in contract, or otherwise) exceed the amount you paid to NCME, if any, for products purchased on this site.

Links to Other Websites

Submissions

Providing or submitting resources, documents or other materials to the NCME website to be considered for inclusion on the site acknowledges that, before the submission is accepted and referenced on the site, NCME may collect a fee to cover NCME expenses for the evaluations of the materials, and the original documents will not be returned to the submitter. NCME will provide a description or abstract only on the website. Licensors must provide a link for members to purchase the entire document(s).

Should any viewer of an abstract of a document on this website respond to NCME with information including feedback data, such as questions, comments, suggestions, or the like regarding the site, or the content of any item, such information shall be deemed to be non-confidential and NCME shall have no obligation of any kind with respect to such information. Further, NCME shall be free to use any ideas, concepts, know-how or techniques contained in such information for any purpose whatsoever, including, but not limited to, developing, manufacturing and marketing products and other items incorporating such information. This paragraph is not intended to apply to any personal information about members or providers (such as name, mailing address and e-mail address), the use of which will be governed by NCME's Online Privacy Statement.

In consideration of NCME's continuing efforts to enhance and improve its products and to respond to feedback from users, you agree to transfer such ideas, concepts, know-how and techniques to NCME without any compensation from NCME. You agree to execute any and all documents that NCME may reasonably request in connection with confirming NCME's ownership of and unlimited right to use such ideas, concepts, know-how and techniques.

You are solely responsible for the content of any comments you make. You agree that no comments submitted by you to this website will:
  1. violate any right of any third party, including copyright, trademark, privacy or other personal or proprietary rights;
  2. be or contain libelous or otherwise unlawful, abusive, or obscene material or constitute the misappropriation of the trade secrets of any third party;

Termination

This Agreement is effective unless and until terminated by either you or NCME. You may terminate this Agreement at any time by no longer using this website, provided that all prior uses of this website shall be governed by this Agreement. NCME may terminate this Agreement at any time and without notice, and accordingly deny you access to this website, in NCME's sole discretion for any reason, including your failure to comply with any term or provision of this Agreement. Upon any termination of this Agreement by either you or NCME, you must promptly destroy all materials downloaded or otherwise obtained from this website, as well as all copies of such materials, whether made under the terms of the Agreement or otherwise.

Resource Release

MERC, the Manufacturing Education Resource Center, (hereafter referred to as "the Clearinghouse") is a project of NCME , the National Center for Manufacturing Education, and is a National Resource Center funded by the National Science Foundation. NCME is based at Sinclair Community College, 444 West Third Street, Dayton, Ohio 45402.

Resource Author Release

By submitting materials for evaluation to the Clearinghouse, the author agrees:
  1. that the author(s) grant(s) NCME specific authorization to reference in the abstract the copyrighted Work,
  2. NCME's acknowledgement that the author(s) own(s) the copyright and has/have the authority to grant a license for the Work's use therein,
  3. to consent for NCME to remove the Work submitted at any time for any reason, and that any fee paid for evaluation will not be refunded.
  4. the Work will not be reproduced or distributed by NCME.
Non-Author Document/Resource Referral

If the right to grant permission release for the document/resource is held by someone other than the submitter or if the document/resource is available only from a third party, the NCME will work with the submitter to contact the original author (or publisher, if necessary) to gain approval for the document/resource's submission and evaluation.
